Emery Studio reserves the right to revise the Terms and Conditions at any time and any such change will be effective once published on the website and consequently will apply to all new orders. Users are responsible for keeping themselves up to date with such changes.

My account

When creating an account, you will be able to choose a password with which you can sign in to your account and view your order history. To use some of the extra features made available to you on this website, you will need to register. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. Should any of your registration information change, please modify it or notify our customer care team immediately by emailing us at contact@emery-studio.com. Please refer to our Privacy Policy for information about how we use your data. It is your responsibility to ensure that your login, password and all other details in relation to your account remain confidential at all times. 

Eligibility to purchase

To be able to purchase an item through the website:
You are required to provide personal details.
You confirm that the personal information you provide is both accurate and true.
You confirm that you are at 18 years or older.
You confirm that you are the holder of a valid credit or debit card.

Placing an order

Shopping on Emery Studio is easy, convenient and secure. Simply select the item(s) you wish to purchase, the desired size and/or colour and add them to your shopping bag. Your shopping bag contains your selected items but does not include the shipping costs which will vary according to the delivery method you choose. To checkout, you can either create an account, sign in with your login details if you already have an account or continue as a guest. Specify your shipping address and you will be able to choose from the shipping methods available to you, specify your billing address, finally choose your preferred payment method and then you may place your order. It is your responsibility to ensure that your personal details are correct, please take caution in order to avoid any errors in the dispatch of the item(s) purchased as we are unable to redirect orders once they are on their way to you.

Before you click “Place Order” on the Checkout page you can still review and edit the personal details you have provided as well as the shipping method and the payment method you have chosen. You can also edit your selected products by clicking on the “Edit Cart” icon and add any coupons or a gift card. We are not able to activate any coupons or gift cards after an order is completed. The coupons must be activated at the checkout stage, before the purchase is completed in order to be valid.


Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the website to fail, your selection of products may be lost.

Shortly after submitting your order and before the order is dispatched, we will send you an e-mail confirming the receipt of your order, where we will include your order number, itemised summary of your order, the total purchase price including shipping costs, the payment method chosen and your delivery details. This confirmation e-mail is an acknowledgement that your order has been received and is not an acceptance of your order. Please note that all orders placed by you are subject to acceptance by us. We reserve the right to refuse any order prior to dispatch if we are unable to obtain authorization for payment, if shipping restrictions apply to a particular item, if the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn. If the issuer of your payment card refuses to authorize payment to Emery Studio, we will not be liable for any delay or non-delivery.

A shipping confirmation email will be sent when we have checked our stock and can confirm we have the goods you ordered. The shipping confirmation email is our acceptance of your order. Please note that Emery Studio does not guarantee that all products on the website are in stock at the time of your order. If a product is unavailable, we will inform you by email as soon as possible before dispatching any other products you may have ordered. If we have already received payment from you, we will refund you for the amount of the unavailable product or for your whole order, should you wish to cancel your entire order. The refund will be issued using the original payment method.

Pricing

The prices and delivery costs shown on the website are denominated in Euros(€) and are inclusive of Value Added Tax (VAT). Transactions are made in Euros(€). All other currencies (GBP/USD) are approximate currency conversions for display purposes only. If your card is not charged in Euros but in a different currency, then you will be charged in accordance to the exchange rate of the day your card issuer proceeds with the transaction. Please note that the prices on this website do not include delivery costs, a sum that will be added to the total amount due upon completion of your order. 

The prices shown on the website may change at anytime without notice and Emery Studio is not bound by the price until we have accepted the order by sending the shipping confirmation to you. If you have placed an order and the price has changed before we have accepted your order, we will notify you by email about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be cancelled. If we have already received payment for a cancelled order we will refund you the amount of the purchase.

Promotion Codes

From time to time, we reward our customers with special promotional offers and coupons via email. These offers are available for a limited time only and expire on the indicated date. Special offers, promotions or discounts are valid while stocks last. To redeem promo codes, simply enter your code in your Shopping Bag and click "Update Cart" or at enter your code and "Apply" at the Checkout page. Only one promo code may be used per online order. Codes cannot be used in conjunction with any other offer or discount. We retain the right to withdraw or extend offers and promotions at any time. The promo code must be activated at the checkout stage, before the purchase is completed in order to be valid.  We are unable to activate any promo codes after an order is complete.

Out of stock items

Customers may choose to submit their email address to join a waitlist for sold out items. In this case we will notify you by email within 24 hours of the product being restocked on the website. Please be aware that, on occasion, certain products that are in high demand might sell out again by the time you receive our email notification and visit our website.

Payment

We must receive payment of the total amount, in full, before your order can be dispatched. The following payments are accepted:

Credit and debit cards - All payments are secure and are handled by Braintree. We are happy to accept most major credit and debit cards including Visa, MasterCard, Maestro and American Express. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Emery Studio, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by your payment provider as a result of payment being processed in respect to your order. Also, note that your order will be processed as soon as your payment is cleared which may take up to 2 working days. You hereby confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it.

Paypal - When selecting the PayPal option, you will be directed to the PayPal website to “Log In” and review the total purchase price before clicking “Pay Now”. Once the transaction is complete, you will be redirected to our website. We reserve the right to not process orders with a different delivery address to your Paypal verified address.

Gift Cards - Gift cards are valid 12 months from the date of purchase.

Cash on Delivery - We only accept Cash on Delivery for deliveries within Greece, with a surcharge of €2.40. Payment will be collected at the time of delivery by the driver.

E-Gift cards

Gift cards are valid for a period of 12 months from the date of issue. They will automatically expire at the end of that period and the balance on the card will be forfeited. When you use your gift card, the amount of your purchase will be deducted from the balance on the card. Unfortunately, change cannot be refunded. To obtain information on your remaining card balance email us at contact@emery-studio.com. Your gift card is non-returnable and cannot be redeemed or exchanged for cash. All items purchased with your gift card may be exchanged in accordance with our return policy. This does not affect your statutory rights.

Order cancellation

For any order cancellation, order amendment, or change of shipping address, contact us immediately within 1-2 hours of placing your order at contact@emery-studio.com. Because we process and dispatch all orders shortly after they have been made, we may not have the possibility to amend or cancel your order.

Shipping Information

The shipping costs are calculated according to the delivery method chosen and the total amount purchased.
The exact shipping costs will be calculated every time an item is added to the shopping basket, and will be displayed on the Checkout page before the customer confirms the order by pressing the ‘Place Order’.

Dispatch may take up to 5 business days but we aim to dispatch all orders within 24-48 hours during weekdays. Orders submitted on Saturdays, Sundays or public holidays will be processed the following workday. Please note that delivery times are provided as estimates only, and commence from the date of dispatch. The delivery times do not take into account possible delays caused by payment authorization and/or stock availability. We are not responsible for any delay due to customs. To avoid delays in receiving your order, please make sure to provide the correct billing and shipping information associated with your credit/debit card when placing an order, as we are unable to redirect orders once they are on their way to you. It is your responsibility to ensure that the delivery address you provide is correct and that you are present to sign upon delivery of the purchased products, at which point responsibility for the products passes on to you. If you have specified another person as the recipient of the purchased products, then their signature serves as evidence of fulfillment of the delivery and likewise transfer of the responsibility. Please check the package is not damaged before signing.


International Shipping to countries in the EU and the rest of the world is carried out by Greek National Post (ELTA) using a trackable, signed-for service at a flat rate of €5.90. Estimated delivery time is approximately 4-15 business days.  We offer free shipping on all orders over 60.
Orders cannot be delivered to PO boxes.

Shipping within Greece is carried out by ELTA Courier at a flat rate of 3.90. Estimated delivery time is 1-3 business days, depending on the delivery address. We offer free shipping on all orders over 40.
Cash on Delivery service (only available in Greece) has a surcharge of 2.40. It is your responsibility to ensure that the delivery address you give us is correct and that somebody is present to sign upon delivery of the purchased products.

Should the customer refuse the delivery of any order to avoid import duties or taxes or for any other reason, the package will be automatically returned to our facilities and the customer will be responsible for the return shipping charged to Emery Studio. The customer will receive a refund for the products but the original shipping costs, return shipping costs and any duties/taxes incurred on the package will be subtracted from the refund.

Tracking an order

It is possible to track your order through your National Post website for International Orders and ELTA COURIER website for delivery in Greece. The shipping confirmation email you will receive will provide the relevant tracking number for your order.

Tax and customs

Delivery within the EU is not subject to duties or additional taxes. However, if you are a customer from a non EU country, you might be asked to pay import duties at customs control. These costs cannot be predicted and are outside our control. Import duties, customs and local sales taxes are the responsibility of the customer. Please be aware that international customs duties and sales taxes are not refunded for shipments outside the E.U.

Returns and exchanges

If you are not fully happy with the goods you have received, you have the right to exchange them for online store credit within 14 days from the day you received your order. We do not issue refunds except when the order is faulty or incorrect upon delivery. 

We will only accept exchanges provided that all items are in unused, undamaged condition with their Emery Studio jewelry box intact. We will not accept exchanges for any items that appear to have been worn, damaged, incomplete and are not in the exact same condition as when you received them. Regrettably, for reasons of hygiene, we do not accept any exchanges/returns of earrings. If your exchange is not approved, due to non-compliance with our return policy, the order will be shipped back to the customer at their expense.

The customer is responsible for the return shipping costs. Please make sure all returned items are well packaged in the original shipping box or any other solid carton box, as not to be damaged in the post. Return packages should be preferably sent with a trackable service, as we cannot take responsibility for items damaged or lost in the return transit. Make sure you obtain a ‘proof of postage’ receipt which you should retain until we’ve received the returned item.

Once we have received the returned products and your exchange has been approved by our Customer Service team, you will be issued online store credit, equal to the returned products' value minus the original shipping costs. The original shipping costs are non-exchangeable/non-refundable and will be deducted from the store credit. You will then be able to make a new purchase for any other item or simply choose a different size of your originally purchased item. If you proceed to make an order of a lower value than your available store credit balance, you will not be charged and any remaining credit will remain on your store credit balance for your next purchase. Please note that we are unable to refund any store credit. Should you proceed to make an order at a higher price than your available store credit balance, you will only be charged for the price difference which will be settled through PayPal or debit/credit card payment. Please note that the re-shipping cost of the new replacement order is the customer's responsibility. In the case that the item you wish to purchase is sold out, you may join its waitlist and we will notify you by email when it is restocked. Issued online credit is valid for a period of 12 months from the date of issue.

Please be aware that international customs duties and sales taxes are not refunded for shipments outside the European Community (EC). 

Faulty products

If you receive defective or incorrect items, please notify us immediately. Returns of faulty items will only be accepted if the goods were faulty when delivered to you, we take every effort to check your purchase thoroughly for any faults before sending them out to you. Returns of faulty goods must be returned to us within 14 days of receipt. All items returned as faulty will be inspected by us and any items deemed subject to fair wear and tear will not be accepted as faulty.
If we consider the products to be defective, we will issue a full refund including original and return shipping costs, or replace it if a replacement is in stock, as per your request. The refund will be made using the original payment method used. Please note, refunds to debit/credit cards normally clear in 1-2 days. Refunds to Paypal can take up to 30 days and are subject to Paypal refund regulations. If you wish to be sent a replacement, please make your request clear when contacting us at contact@emery-studio.com. Please be aware that international customs duties and sales taxes are not refunded for shipments outside the European Community (EC).

Claims

Any claims made before prior communication with our Customer Service team will not be considered. All goods must be counted and checked at the time of delivery. Any damage or faults must be reported on receipt of the goods. This does not affect your statutory rights as a consumer. Any claim in respect to the above should be made by e-mailing contact@emery-studio.com within 2 days of delivery. No claims will be entertained unless the above conditions are strictly adhered to. No credit or refund will be given for any goods ordered in error by the customer. No credit or refund will be given for any losses due to the incorrect storage or handling by the customer of any goods supplied by Emery Studio.

Liability

If the goods we deliver are not what you ordered, or are damaged or defective, or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email of the problem within 7 working days of the delivery of the goods in question. If you notify us of a problem under this condition, our obligation to you will be either:
To rectify any shortage or non-delivery; or
To replace any goods that are damaged or defective; or
To refund you the amount paid for the goods in question.
Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses howsoever arising out of any problem you notify us of under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question as stated above. We cannot be held responsible for any delays once the goods have left us and are in possession of the courier or Greek National Post (ELTA). You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site.

Accuracy of content

Emery Studio has made every effort to describe the products on the website as correctly as possible,as well as, display the colours of the items as realistically as possible. While the colour reproduction of the products is a very close representation, we cannot accept any responsibility for any variation in colour caused by your browser software or your computer monitor. Some items may appear slightly larger or smaller than actual size due to screen defaults and photography techniques. Other items may appear slightly larger than actual size to clearly show small details.

Privacy policy

We take all reasonable care to keep the details of your order and payment secure and in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website. Resale policy

You may purchase products for personal use only and not for resale. By placing an order on the website, you certify that you are purchasing products for your own personal use and not for resale. We reserve the right to refuse orders for any reason without explanation.

Force majeure

We are not responsible under these Terms and Conditions for any acts or events outside our reasonable control (force majeure), that adversely affect your purchase, including (but not limited to) strikes, lockouts, failures of third party systems or networks, acts of god, fire, earthquake, storm, flood or other natural disaster, civil unrest, acts of terrorism, deliberate sabotage of or malicious damage to equipment or data or for damage to or destruction of premises or equipment. In case of force majeure, Emery Studio’s obligations will be suspended. If, due to force majeure we fail to deliver your order within the set time-limit, we will contact you via email in order to confirm whether you wish to proceed or withdraw your order.

Disclaimer of warranties & liability

The website, and any content available on the website, are provided on an "as-is" and "as available" basis. To the fullest extent permitted by law, Emery Studio disclaims all warranties, express or implied, including but not limited to all warranties of merchantability, fitness for a particular purpose, title and non-infringement. You expressly agree that use of the website is at your sole risk and you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of the website. Neither we nor any of our business partners represent or warrant that the website will be uninterrupted or error-free, that defects, if any, will be corrected, or that the website is free of viruses or other harmful components; nor do we or they make any representations or warranties about the accuracy, reliability, currency, quality, performance or suitability of the website or any content available on the website. In the event of any problem with the website or any content, you agree that your sole remedy is to cease using the website. Emery Studio shall not, under any circumstances, be liable for any damages of any nature that may occur, by way of example, as a result of: errors or omissions in the content, unavailability of the website or the transmission of viruses or malware in the content, in spite of having adopted all the technological measures required to prevent this.

Ownership of rights

All rights, including copyright, in this website are the property of www.emery-studio.com. Any use of this website or its content, including but not limited to, trademarks, graphics, videos, photos and logos, for any purpose other than for your own personal, non-commercial use, is strictly prohibited without our prior written consent.

Violation of rules

We reserve the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. A breach or violation of any of the Terms will result in an immediate termination of your services.

No waiver

If Emery Studio chose not to take legal action against a user following a breach of the Terms and Conditions on their behalf it does not mean legal action will not be taken if the user commits another act that disregards the site’s terms, conditions or policies, whether the breach is different or not.

Amendments

We reserve the right to change these Terms and Conditions at any time by posting the changes on the website. Any such amendment shall be effective once the revised terms have been posted on the site. You will be subject to the Terms & Conditions in force at the time you place an order with us. We encourage you to visit this section of our website periodically in order for you to remain informed of any changes.

Governing law and jurisdiction

All legal disputes arising out of or in connection with purchasing through www.emery-studio.com shall be governed exclusively by Greek law (EU law) and shall be subject to the exclusive jurisdiction of the competent court of the city of Athens, Greece.
